Terms of service

1. Acceptance of terms

By accessing or purchasing through tys-med.com, you accept these Terms of Service. If you do not agree, do not use the site or purchase our products.

2. Eligibility

You must be at least 18 years old and legally able to enter into binding contracts. Purchases of prescription-restricted medical equipment require additional credentials (see Section 6).

3. Products and pricing

• All prices on the site are in U.S. dollars (USD).
• Prices exclude the Dominican ITBIS (18%), which is calculated at checkout.
• Shipping within the Dominican Republic is a flat $15 USD. International shipping is quoted separately.
• We reserve the right to correct pricing errors before shipment.
• Product images are representative; specifications are authoritative.

4. Orders and payment

• Orders are confirmed by email and become binding when payment is received (or, for credit accounts, when accepted by our team).
• We accept cash on delivery, bank transfer, Stripe and PayPal. Credit terms are available for approved institutional accounts.
• We may decline orders at our discretion (suspected fraud, restricted product without credentials, out-of-stock, pricing error).

5. Delivery and risk of loss

Title and risk of loss pass to you upon delivery to the address you provide. You are responsible for inspecting goods on receipt and reporting damage within 7 days.

6. Prescription-restricted equipment

Certain devices (defibrillators, prescription-only diagnostics, anesthesia equipment, controlled lasers and others) can only be sold to licensed healthcare professionals or facilities. We may request:

• Professional license number (CMD, ADN, MISPAS registration, etc.).
• Facility credentials.
• A signed prescription or purchase order on facility letterhead.

We will refuse or cancel any order that fails verification.

7. Returns and warranty

Returns are governed by our Shipping & Returns policy and warranty terms by our Warranty page, both of which are incorporated here by reference.

8. Use of the website and account

• You are responsible for the confidentiality of your account credentials.
• Do not attempt to disrupt, reverse-engineer or scrape the website.
• Do not impersonate another person or facility.

9. Intellectual property

All content on tys-med.com — including logos, text, images, designs and source code — is owned by TYSMED or licensed to us, and is protected by Dominican and international copyright and trademark laws. No content may be reproduced without written permission. Brand names are trademarks of their respective owners.

10. Clinical responsibility

TYSMED supplies equipment; we do not practice medicine. The selection, prescription, configuration and clinical use of any device is the sole responsibility of the licensed healthcare professional or facility. Always follow the manufacturer's IFU (Instructions for Use).

11. Limitation of liability

To the maximum extent permitted by Dominican law, TYSMED's total liability arising from any sale or use of our services shall not exceed the amount you paid for the product giving rise to the claim. We are not liable for indirect, incidental or consequential damages (including lost profits, lost data or business interruption).

Nothing in these Terms limits liability for fraud, gross negligence or death/personal injury caused by our negligence.

12. Indemnification

You agree to indemnify TYSMED against claims arising from misuse of products, breach of these Terms, or violation of any law in connection with your use of our services.

13. Force majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, customs delays, pandemics, strikes or supplier failures.

14. Governing law and jurisdiction

These Terms are governed by the laws of the Dominican Republic. Any dispute shall be submitted to the competent courts of the National District (Distrito Nacional), Santo Domingo.

15. Changes

We may update these Terms at any time. Continued use of the site after a change constitutes acceptance.
